The rules for using this website and the limits of what the content promises.
1. Acceptance of these terms
By accessing or using fixandflippers.com (the “site”), you agree to these Terms of Use. If you do not agree, do not use the site. These terms apply to all visitors, including borrowers, investors and referral sources.
2. What Fix and Flippers does
Fix and Flippers is a mortgage broker. We arrange real estate financing through third-party private lenders and wholesale commercial lenders. We are not a bank, a direct lender, a loan servicer, a law firm, an accountant or a financial adviser. We do not fund or service loans, and we do not make credit decisions.
Any loan terms, rates, leverage, fees or timelines shown on the site are illustrative unless a lender has issued a written term sheet. Lender terms control. A lender’s commitment to lend is subject to its underwriting, appraisal, title, insurance and closing conditions.
3. No offer or commitment
Nothing on this site is an offer to lend, a commitment to lend, or a guarantee that financing will be available. Submitting a scenario does not create a loan application, a broker-client relationship or an obligation to pay any fee. An application is created only when you and the lender complete the required process.
Eligibility depends on the property, the borrower, the market, the lender’s guidelines and applicable law. Not all products are available in all states.
4. Your responsibilities
You agree to provide accurate, current and complete information, to use the site only for lawful purposes, and not to interfere with its operation, attempt to gain unauthorized access, scrape it at a rate that degrades service, or submit false or fraudulent information. You are responsible for the documents and information you send.
Do not submit Social Security numbers, account numbers or other highly sensitive information through the website form. The desk will provide a secure method when those documents are needed.
5. Broker compensation and conflicts
Fix and Flippers may be compensated by the lender, the borrower or both. Compensation and lender relationships are disclosed in the transaction documents. The desk may receive different compensation from different lenders; the recommendation is based on the fit of the program, not solely on compensation.
6. Content and intellectual property
The site’s text, design, graphics, logos and code are owned by Fix and Flippers or used with permission, and are protected by applicable intellectual property laws. You may view, download and print pages for your own non-commercial use. You may not reproduce, republish, sell or create derivative works from the content without written permission, except for short quotations with attribution.
7. Third-party links and services
The site may link to lender portals, title companies, event pages, social media and other third-party sites. We do not control those sites and are not responsible for their content, products or privacy practices. A link is not an endorsement. Review the third party’s terms before providing information or entering a transaction.
8. No professional advice
The content on this site is for general information. It is not financial, investment, legal, tax or accounting advice, and it is not a substitute for advice from a qualified professional who knows your situation. Real estate and lending involve risk, including the risk of loss. Past performance and illustrative deal structures are not a promise of future results.
9. Disclaimer of warranties
The site and its content are provided “as is” and “as available.” To the maximum extent permitted by law, Fix and Flippers disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.
10. Limitation of liability
To the maximum extent permitted by law, Fix and Flippers and its officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or opportunity, arising from your use of the site or reliance on its content. Where liability cannot be excluded, it is limited to the amount you paid to access the site, if any.
11. Indemnity
You agree to indemnify and hold harmless Fix and Flippers from claims, losses, liabilities and expenses arising from your use of the site, your violation of these terms, or information you submit that is inaccurate or infringing.
12. Privacy
Our handling of personal information is described in the privacy policy, which is incorporated into these terms by reference.
13. Changes and termination
We may update these terms at any time by posting a revised version with a new effective date. Continued use of the site after changes means you accept the revised terms. We may suspend or terminate access to the site at our discretion.
14. Governing law
These terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles. Any dispute arising from the site or these terms will be brought in the state or federal courts located in New Mexico, unless applicable law requires otherwise.
